Status on Exclusive Use Areas

STATUS ON EXCLUSIVE USE AREAS 

If you own a section in a sectional title scheme that was registered before 1988, you should check the status of the exclusive use areas (‘EUA`s’).  EUA`s are those parts of the common property in a scheme that have been set aside for the exclusive use of owners, such as parking bays & garages.  They can either be formally registered in the name of an owner by Notarial Deed or (since 1988) allocated in terms of the scheme’s Rules. 

If the EUA is held by Notarial Deed the owner can sell, mortgage or lease it.  This is not possible if it is held in terms of the scheme’s Rules.

In schemes opened prior to 1988, owners may request the Trustees to convert EUA`s from those governed by Rules to Notarial titles. 

Owners who wish to do this should contact one of the conveyancers at Smith Tabata Buchanan Boyes to affect the necessary registration.
